SOUTH CAROLINA SUPREME COURT GRANTS BOOST’S
PETITION TO HEAR HELMET LAW CHALLENGE (Myrtle Beach, SC – June 15, 2009) ... Representatives of Business Owners Organized to Save Tourism (BOOST) are greatly encouraged by the decision of the South Carolina Supreme Court to immediately hear BOOST’s challenge to the Myrtle Beach motorcycle helmet law. On June 12, 2009, the Supreme Court granted the Petition filed by BOOST and Bart Viers seeking to have their challenge to the Myrtle Beach helmet law heard in the Supreme Court’s “original jurisdiction,” a rarely-used mechanism employed by the Supreme Court to quickly resolve controversies of substantial public importance. BOOST attorney Thad Viers of Coastal Law LLC stated: “We appreciate the Supreme Court’s agreement to immediately take the case. This litigation could have dragged on for years without Supreme Court intervention. Now we will almost certainly get a decision on the validity of the Myrtle Beach helmet law well ahead of next year’s motorcycle rallies.” “There is no way to know how the Supreme Court will ultimately rule,” noted BOOST founder Robert Kelly, “but we are very encouraged by the Court’s decision to forego the lower courts and immediately hear the case.” Kelly continued: “The Supreme Court’s willingness to entertain this matter in its rarely-invoked original jurisdiction also highlights the public importance of the litigation. For example, the most recent original jurisdiction case was the nationally watched federal stimulus funds case involving Governor Sanford.” BOOST spokesperson Tom Herron added: “The continued attacks on motorcycle tourism have devastated the local economy. At this point, 2009 may go down as the worst year for tourism in modern memory ������������������� and the economic damage to motorcycle-themed businesses is now spreading to other sectors of our economy. Some businesses will simply not recover. For those who do survive, BOOST will continue to pursue every available avenue to increase tourism and to put an end to the sort of selective tourism that hurts all of us.” # # # # #
