Child Custody

 

A decision about child custody arises when a Husband and Wife separate or divorce according to South Carolina law. There are two basic types of legal custody, sole custody and joint custody.  It is the judge that considers the “best interests” of the child when making a custody determination. Some of the factors a court may consider in determining the “best interests” of the child include:

  • Each parent’s conduct (immoral or illegal)

  • The relative fitness of each parent

  • Parenting skills of each parent

  • Who has been the primary caretaker of the child

  • The time a parent can allocate to spend with the child

  • Resources of each parent

  • Child Support Issues

Child custody is almost always the most emotional and sensitive issue concerning divorce. The welfare of the children is usually the prevailing concern for both parents.


Mediation
We encourage clients to try to avoid a full-fledged court battle over custody issues. We can guide our clients through mediation or when necessary represent them in court to achieve their goals.
